TERMS & CONDITIONS FOR PURCHASES MADE THROUGH FIRE SPRINKLER DESIGN
Please read these Terms & Conditions carefully. By submitting payment, placing an order, requesting Fire Sprinkler Design – CA to begin work, or accepting any proposal or estimate issued by Fire Sprinkler Design – CA, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
These Terms & Conditions are incorporated into and form a part of every proposal, invoice, estimate, order, and agreement issued by Fire Sprinkler Design – CA.
DEPOSIT & CANCELLATION POLICY
A 10% cancellation fee will apply to all projects canceled within five (5) business days of payment. Deposits become non-refundable after five (5) business days due to scheduling, administrative processing, project preparation, and reserved production time.
Any approved refund shall be less all applicable cancellation fees, non-refundable credit card processing fees, and any charges for work performed prior to cancellation, including but not limited to plan review, engineering, drafting, hydraulic calculations, consultations, research, coordination, permitting assistance, and administrative services billed at $85.00 per hour.
Any approved refunds will be processed within ten (10) business days.
CREDIT CARD PROCESSING FEE
All payments are processed electronically by credit or debit card. A payment processing fee, currently 3.1% of the transaction total, may be added to invoices or automatically calculated during checkout. This fee is separate from the contract price and is intended solely to recover payment processing costs. If payment processor rates or associated costs change, the processing fee may be adjusted accordingly.
The processing fee is non-refundable once payment has been processed.
CHARGEBACKS / PAYMENT DISPUTES
If a customer initiates a credit card chargeback or payment dispute for any amount, a $30.00 administrative chargeback fee will be assessed regardless of the outcome of the dispute. This fee is intended to offset payment processor fees and the administrative costs associated with responding to the dispute and is in addition to any other amounts owed under this Agreement.
The customer agrees not to initiate a chargeback or payment dispute without first making a good-faith effort to contact Fire Sprinkler Design – CA and provide a reasonable opportunity to resolve the matter directly.
If the chargeback or dispute is resolved in favor of Fire Sprinkler Design – CA, the customer remains responsible for the original balance due, the $30.00 administrative chargeback fee, all non-refundable payment processing fees, and any additional costs, fees, collection expenses, or attorney's fees incurred by Fire Sprinkler Design – CA in responding to or collecting the disputed amount, to the fullest extent permitted by applicable law.
INSTALLATION BY OTHERS
Fire Sprinkler Design – CA is the design division and DBA of Innovative Fire Systems, Inc. (California C-16 Contractor License No. 958518).
Fire sprinkler systems designed by Fire Sprinkler Design – CA are not required to be installed by Innovative Fire Systems, Inc. However, if installation will be performed by another contractor or owner-builder, Fire Sprinkler Design – CA shall be notified prior to installation.
Additional documentation, including an Installer Acceptance & Responsibility Agreement, may be required before design documents and/or permit-related documentation are released.
The installing contractor and/or property owner shall be responsible for all installation-related activities, including field verification, workmanship, inspections, testing, code compliance during construction, and final system performance.
OWNERSHIP OF DOCUMENTS
All drawings, hydraulic calculations, specifications, and other documents prepared by Fire Sprinkler Design – CA remain the intellectual property of Fire Sprinkler Design – CA until all amounts due have been paid in full.
Upon receipt of full payment, the customer is granted a non-exclusive license to use the documents solely for the construction of the specific project for which they were prepared.
The documents shall not be reused, modified, copied, sold, transferred, or used for any other project without the prior written consent of Fire Sprinkler Design – CA.
ACCEPTANCE OF TERMS
By submitting payment, placing an order, requesting Fire Sprinkler Design – CA to begin work, or accepting any proposal or estimate issued by Fire Sprinkler Design – CA, the customer acknowledges that these Terms & Conditions have been read, understood, and accepted in their entirety.
